The claim filed in Delaware
Kituwah LLC took Emmitt Smith to court on Monday. The investment and economic development arm of the Eastern Band of Cherokee Indians filed in Delaware’s Chancery Court, and it wants at least $2.5 million back.
The money went into Project Exodus, a planned solar farm in Texas. Kituwah lent it in 2023. Repayment came due on February 1, 2024. The fund says it has not recovered a penny since.
The complaint names Smith, business partner David Mosley and their commercial real estate company, 4 13 Solutions Inc. It alleges fraudulent inducement, breach of fiduciary duty and breach of contract, and it seeks interest, expenses, attorneys’ fees and further damages to be set at trial.

Where the money went, according to the suit
Kituwah’s central allegation concerns what happened to the loan. The filing claims Smith’s group routed the funds to Wilson Holdings, a company they already owed, rather than into the project. The suit compares that arrangement to a Ponzi scheme.
The fund also says it committed the money on the strength of false projections and data, and that it was told repayment would arrive within months. What followed, according to the filing, was a steady stream of lies from the defendants.
None of it has been tested in court. These are allegations in a civil complaint, and no ruling has been made. Front Office Sports tried to reach Smith and the other defendants and got no response.
The name attached to it
Smith is 57 and carries one of the heaviest résumés in the sport. He won three Super Bowls with the Dallas Cowboys, retired after the 2004 season with 18,355 rushing yards, and still holds the NFL career rushing record more than two decades later. Canton inducted him in 2010.
Retired stars lending their names to investment vehicles is not new, and neither is the litigation that sometimes follows. What stands out here is the size of the counterparty. Kituwah exists to grow money for a tribal nation, not to chase a running back through Chancery Court.
Smith has not filed a response.
